This volume critically explores the basis and the goal of punishment from the standpoint of the right to punish. The work reviews the main doctrines that have dealt with the theme of punishment from Antiquity to the present, not limiting itself to the legal-philosophical sphere but also analyzing the contributions from other social sciences. It then explores how these are reflected in the sphere of Positive Law.

Deze bundel is samengesteld ter gelegenheid van het afscheid van Martin Moerings als hoogleraar Penologie aan de Universiteit Leiden op 4 maart 2011. Tijdens zijn veelzijdige loopbaan heeft Moerings een wetenschappelijke benadering van het recht gecombineerd met een actieve inzet in de rechtspraktijk en de criminologie. Martin Moerings heeft altijd een bijzondere belangstelling gehad voor de (rechts)positie van gedetineerden binnen de samenleving en binnen het gevangeniswezen. In zijn onderzoek en publicaties richt hij zich niet alleen op de juridische implicaties, maar heeft hij eveneens oog voor de sociologische en criminologische aspecten. Naast, maar tegelijkertijd deels ook verbonden met, voornoemd penologisch aandachtsgebied hebben stigmatiserings- en labellingsprocessen ook immer Martins aandacht gehad. Al deze thema’s komen aan bod in dit liber amicorum.

Zowel voornoemde thematiek als de multidisciplinaire benadering daarvan vormt een belangrijk onderdeel van het facultaire onderzoeksprogramma Criminal Justice: Legitimacy, Accountability and Effectivity. Het begrip ‘Criminal Justice’ bestaat in de Angelsaksische wereld sinds de twintiger jaren van de vorige eeuw en doelt op het stelsel van principes, regels, handelingstypen (practices) en instituties, waarmee de overheid sociaal ongewenst gedrag sanctioneert. Het concept veronderstelt – en daarin ligt ook zijn kracht – dat het erom gaat wetgeving, rechtspraak, beleid, politiepraktijken enzovoort als één stelsel op te vatten. Dit vereist dat de bestudering van criminaliteit en de aanpak daarvan niet los van elkaar staan. Dat de multidisciplinaire aanpak van Martin Moerings daar niet alleen een bijdrage aan heeft geleverd, maar ook velen om hem heen heeft geïnspireerd, daar getuigt dit liber amicorum van.
